General
These Terms of Use govern the conditions of use for the Kitchenfinder platform (hereinafter referred to as “Kitchenfinder”). Kitchenfinder (www.kitchenfinder.net, including related subdomains) is operated by Molindo Plus GmbH (hereinafter referred to as “Molindo”). By accepting these Terms of Use, a legally binding agreement is formed between the user and Kitchenfinder regarding the use of the services offered.
Molindo Plus GmbH also operates additional platforms and services under Küchenfinder.com, Badratgeber.com as well as various subdomains and aliases of these domains. Collectively, these platforms and services are referred to as the “Kitchenfinder Network.”
These Terms of Use also apply if Kitchenfinder is accessed partially through other websites, applications, or downloads and via email. Use of Kitchenfinder is prohibited if it violates the laws of the user’s jurisdiction. Additional written terms may apply for providers and partners.
1. Service Description
1.1. Kitchenfinder is a platform focused on kitchen-related topics. It allows kitchen providers to showcase their services and utilize paid services.
1.2. Kitchenfinder connects kitchen inquiries from users with professional providers. Users must complete a contact form to use this service. After submitting the form, the kitchen inquiry, including the user’s contact details, is forwarded to the chosen provider, who will then directly contact the user via phone or email to continue kitchen planning and provide quotes.
1.3. Once Kitchenfinder facilitates the connection between the user and the provider, contract formation is solely between the provider and the user. Any disputes related to the contract must be resolved between these parties.
1.4. Kitchenfinder may contact the user at a later stage to inquire if an offer was received from the provider.
1.5. Users can notify Kitchenfinder at any time if they no longer wish to be contacted by a provider. Kitchenfinder will promptly forward this request to the relevant provider.
1.6. Submitting a kitchen inquiry is free of charge and non-binding for users. In return, Kitchenfinder may request users to review the service of the recommended provider and indicate if a contract was formed.
2. Use of the Platform
2.1. Users must register before accessing services requiring registration on Kitchenfinder. Users must provide accurate and complete information and ensure their information remains up to date.
2.2. By registering, users explicitly agree to these Terms of Use. Conflicting terms are not recognized.
2.3. The services requiring registration are intended only for individuals aged 18 or older. Users affirm that they are of legal age at the time of registration.
2.4. Kitchenfinder cannot guarantee that the person registered is the individual they claim to be. Therefore, Kitchenfinder does not warrant the true identity of users.
2.5. Membership duration is not bound to a specific term.
2.6. When services from partners are offered, their terms of use or general terms and conditions apply.
2.7. Users are responsible for maintaining the confidentiality of any passwords used for accessing Kitchenfinder services and must notify Kitchenfinder immediately if they become aware of unauthorized third-party access. Users are liable for any damage to Kitchenfinder arising from third-party use due to the user’s negligence.
3. Data Sharing
The necessary personal data of users (inquiry details and contact information) is shared with providers exclusively for handling the inquiry. By submitting an inquiry, users explicitly accept these terms, including the sharing of their data with providers. Data will not be shared with third parties unrelated to the inquiry.
4. Content
4.1. Users may upload images, text, documents, and other content (collectively referred to as “Content”) to Kitchenfinder. Users bear full responsibility for any content they upload.
4.2. Users decide what content to use for inquiries, profiles, and presentations and provide it to Kitchenfinder for publication. Users agree not to upload content containing pornographic, degrading, racist, or illegal depictions. Kitchenfinder does not pre-screen content.
4.3. Users grant Kitchenfinder and the “Kitchenfinder Network” a non-exclusive, free, unlimited license to use, reproduce, distribute, display, modify, and make their content publicly accessible. Kitchenfinder may use this content on its platforms, social media (e.g., Facebook, Instagram), and for advertising. Users guarantee they have the rights to any uploaded content or proper authorization to share it and grant usage rights.
4.4. If third parties assert rights over a user’s content used by Kitchenfinder, users shall indemnify Kitchenfinder from any valid claims, including reasonable legal defense costs.
5. Reviews
5.1. Kitchenfinder allows users to submit reviews. Reviews must be based on factual experiences and represent the user’s opinion.
5.2. Reviews must be fair, objective, and not contain defamatory, offensive, or unlawful content. Violating reviews will be removed.
5.3. Users agree to provide truthful information and only publish personal data with the explicit consent of the person concerned.
5.4. Users may only publish their own opinions, not those of third parties. Spreading rumors or third-party statements is prohibited.
5.5. Kitchenfinder will investigate valid complaints about reviews and take corrective action if necessary. Prohibited are multiple unjustified reviews, self-reviews, or other attempts to manipulate the review system.
5.6. By submitting reviews, users grant Kitchenfinder perpetual, unlimited rights to use them. Kitchenfinder may process and publish reviews as desired within the Kitchenfinder Network.
6. Data Protection
Personal data is treated according to applicable Austrian data protection laws and is collected, processed, and used only for the contractual relationship and billing. More details are outlined in the Privacy Policy.
7. Disclaimer of Warranties and Liability
7.1. Kitchenfinder provides services as deemed appropriate and reserves the right to modify or terminate services at any time.
7.2. Users are solely responsible for the content they upload, including reviews and recommendations. Users indemnify Kitchenfinder from any third-party claims relating to user content.
7.3. Users use Kitchenfinder at their own risk. Kitchenfinder does not guarantee that every inquiry will be matched with a provider, nor does it ensure contract formation or fulfillment.
7.4. Kitchenfinder does not warrant the accuracy or reliability of the information and services provided.
7.5. Kitchenfinder does not guarantee uninterrupted, error-free operation of its hardware or software and disclaims liability for data loss or corruption resulting from the use or inability to use Kitchenfinder.
7.6. Kitchenfinder is not liable for contracts or services provided by providers. Users decide independently whether to accept an offer. Kitchenfinder is not a party to any resulting contract.
7.7. Kitchenfinder disclaims responsibility for external content linked on its platform. The respective providers of such content are responsible.
7.8. Kitchenfinder is not responsible for user or third-party behavior or statements made within the platform.
8. Severability Clause
If any provision of these Terms of Use is invalid or unenforceable, the remaining provisions remain unaffected.
9. Final Provisions
9.1. Kitchenfinder reserves the right to modify these Terms of Use with reasonable notice. Changes will be communicated by email and are considered accepted if not opposed within four weeks.
9.2. Kitchenfinder may introduce new services or remove existing ones at its discretion.
9.3. All legal relationships between Kitchenfinder and users are governed by the laws of Austria.
9.4. Registration for Kitchenfinder is only available in English.
